What to do if you are the victim?

1) Kindly reply asking to prove you evidence that makes them believe they are recast. And ask to specify in detail what miniatures they believe are fake if more than one, and on what basis.

2) Send them pictures of the original receipts (HA HA HA) if you still have them, pictures of the packaging if you have it.

3) Be cooperative, but question any request, as they are quite subtle.

4) Contact a lawyer and ask for advice. Several can give you free advice and suggest you how to proceed.

5) Spam all over what you are at with them, make the community aware of their unfair and unjust attack's.

6) NEVER send them the model, keep them and make them only available if a court rules it.

7) If the damaged caused is sensible, such as a permanent ban from a site, or defamation occurs I strongly suggest to get a lawyer.

Laws vary in each nation. But in the US you can file them to court requesting for damage and get quite some reimbursement. Reporting you based on a non verified evidence can lead to as examples:

1) Personal monetary loss (your time, money invested and lost from loosing a sale)

2) Defamation as reporting you with no tangible evidence is a felony.

The accusations can vary based on the country you are in.

TRY TO AVOID THE SITUATION BY BEEING PROACTIVE:

To prevent arbitrary and damaging intervention by GW Legal Department you can add a sentence to your auctions/sales/site/kickstarter. In the statement clearly express your request for the Legal Department to contact you before arbitrarily closing an auction based on assumptions.
An example:

At Games Workshop Legal Department, if my auction was reported to you as suspicious, I demand you contacting me before the site owner (VeRO program in case of eBay) with the reason you believe it is a counterfeit or why doesn't match your guidelines. It has come to my attention that your company is conducting an unfair and aggressive campaign against sellers that is causing unjust harm and losses.

Current actions I am aware of.

a) Spain - 4 eBay sellers are working with a lawyer to sue GW, 1 got his account suspended for life. Awaiting updates if any will be given to me.

b) Italy - 3 eBay sellers have contacted GW with the lawyer, after the responses they got they started the process to sue GW for damage, defamation, and inadequate business practices. One user had an eBay account used for his business, and he was banned from eBay for life after GW took down over 100 auctions or so. I understand they will be suing GW in Sep/Oct 2022 via the Italian court.

c) USA - 6 eBay users are discussing getting a lawyer, 2 were banned by eBay due to GW actions.
